The Constituency-5 of Dhanusha district, from where Dr Ram Baran Yadhav have elected as the Constituent Assembly (CA) member, had been automatically vacated after Dr Yadav got elected as the first President of the country. The CA sitting held Wednesday took decision in this regard.
Kul Bahadur Gurung, who has been acting as the speaker of the CA announced the house session that Dr Yadav, then general secretary of the Nepali Congress had won the election to CA member from that constituency turned the president of the country, thus the constituency has fallen vacant.
Article 36 (b) and its clause 4 of the Interim Constitution states that constituency will be automatically vacated if a CA member is elected to the post of President or Vice President.
Wednesday's session of the CA also endorsed the first amendment to the interim working procedure of the CA.
The proposal was tabled by Maoist CA member Dinanath Sharma and it was supported by NC and UML CA members Laxman Prasad Ghimire and Ramchandra Jha respectively.
